The Maintenance Court was established specifically for the public to be able to approach it directly and without legal representation.
The necessary forms to claim maintenance in the Maintenance Court can also be found online at www.justice.org.za or simply by following this link for an Application for Maintenance Order: https://www.justice.gov.za/forms/maintenance/MNT_Form%20A.pdf
The Domestic Violence Court was also established for the public. The public can approach this court without any legal representation. The necessary forms used in the Domestic Violence Court that need to be completed if you require a protection order, is available online under Domestic Violence Act, more specifically Form 2. Follow this link for an Application for Protection Order: https://www.justice.gov.za/forms/dva/J480_dva-form02-afr.pdf
The above-mentioned forms are relatively simple to complete. After the forms have been completed, they are taken to the appropriate court and the official there will assist you with the process.
Traditionally the Maintenance Court and the Domestic Violence Court form part of the Magistrate’s Court. The simplest would be to approach the Clerk of the Magistrate’s Court and ask to be referred to the correct division/person.
